Scope and Timeline

EU member states must implement the directive by June 7, 2026. Employers with 100+ employees will need to publish gender pay gap reports, with stricter requirements for those with 250+ employees.

Key Employer Obligations

Provide salary ranges to job applicants and prohibit questions about salary history Make criteria for pay and progression publicly accessible and gender-neutral Ban pay secrecy clauses in contracts Allow employees to request average pay information by gender for comparable roles

Reporting Requirements

Employers must report the mean/median pay gap and break this down by pay components. If the data shows a pay gap of ≥5% that cannot be justified, the employer must conduct a joint pay assessment and remedy the gap within six months.

Enforcement and Penalties

Member states will impose effective, proportionate and dissuasive penalties (including fines) for violations. Workers are entitled to full compensation for damages, back pay and non-material harm with no cap. Organisations that fail to comply face heightened litigation risk and may be barred from public contracts.
